1. Introduction
By accessing or using PropRetire (“the Platform”), operated by Propretire Pty Ltd (ABN 53 696 271 619), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.
2. Definitions
In these Terms:
- "Account" means your registered user account on the Platform.
- "Content" means any data, text, files, or information uploaded or entered by you.
- "Platform" means the PropRetire website, APIs, and associated services.
- "Subscription" means a paid plan granting access to premium features.
- "User" or "you" means any person accessing or using the Platform.
- "We", "us", or "our" means Propretire Pty Ltd.
3. Account Terms
To access certain features of the Platform, you must register for an account. You must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your login credentials.
4. Acceptable Use
You agree not to misuse the Platform. Prohibited activities include unlawful use, unauthorised access, interfering with platform integrity, uploading malicious code, scraping data, and impersonating any person or entity.
5. Intellectual Property
The Platform and its entire contents are owned by Propretire Pty Ltd. You retain ownership of Content you upload. You must not reproduce, distribute, or modify any part of the Platform without our express written permission.
6. Subscription & Payments
Certain features require a paid Subscription. PropRetire currently offers Pro and Business plans. Fees are billed in advance on a monthly or annual basis. All fees are in Australian Dollars and include GST. Subscriptions automatically renew unless cancelled.
7. Limitation of Liability
To the fullest extent permitted by law, Propretire Pty Ltd shall not be liable for any indirect, incidental, or consequential damages. The Platform is provided on an "as is" basis. PropRetire is educational software and does not constitute financial, legal, or tax advice.
8. Dispute Resolution
Any dispute shall first be addressed through informal negotiation. If unresolved, it shall be referred to mediation administered by the Australian Disputes Centre. These Terms are governed by the laws of New South Wales, Australia.
9. Termination
We may terminate your access to the Platform immediately if you breach these Terms. If paid access ends or the account is terminated, stored portfolio data may be retained for up to 90 days before deletion unless a longer retention period is required by law.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect.
